ISGM have filed and served their defence, denying the allegation that group members who entered sub-contracting arrangements with ISGM were actually employees of ISGM.
On 14 May 2019, Shine Lawyers and ISGM appeared before the Federal Court of Australia for a case management hearing to discuss a range of legal matters including a cross claim, reinstatement application, common fund order and declassing/opt-in application. These will be heard by the Court in early August 2019 or early October 2019, depending on the Court’s availability. Shine will be in contact with members who have registered for the Class Action once the hearing date has been confirmed.
Shine and your Union strongly believe in the prospects of this case and will fight tirelessly to ensure that justice is delivered, and you receive the benefits that you are rightfully entitled to. We encourage you to inform others, who may at some point have provided services to Tandem/ISGM, about the class action and the registration process so that the case can gather as much support as possible.
We will update members as the matter progresses. In the meantime, if you require any further information, please contact Branch Officials Peter O’Connell or James Perkins on (02) 9893 7822.
