How much pay can Post withhold for stoppages of varying lengths?

Over the past few days there has been a significant number of reports and gossip regarding management releasing misleading information of Australia Post intentions of withholding a full day’s pay if members take part in stoppages of less than a full shift.

Most of these reports and gossip etc seemed to have emanated from confusion due to the deliberate wording of notices to the intentions of Australia Post in withholding pay for a whole shift where members engage in partial work BANS.

Members are advised – when taking part in stoppages whether you stop work for a full shift, or for one hour, there is no provision under the Fair Work Act 2009 for Australia Post to withhold wages for one minute more than the time that you have actually stopped work.

Unlike ‘partial work bans’ mentioned above, if you engage in a stoppage for one hour, you can only be docked for one hour only. If you engage in a stoppage for two hours, you will be docked for two hours only…and so on. If you stop work for a full shift, you will be docked for a full shift.

Remember: when taking part in a STOPPAGE OF WORK, protected under the Fair Work Act 2009, Australia Post are unable to withhold pay outside of the time you actually stopped work – FULL STOP!

Members are advised to report to your Union Official, the time and date along with the name of the Australia Post manager who is threatening to withhold pay for stoppages of work outside of the abovementioned facts provided for under the LAW.

This information will then be reported to the Commonwealth Workplace Ombudsman for investigation and action to be taken against those Australia Post managers for breaking the LAW.
